GENERAL CONDITIONS OF SALE

xAlp sas di Francesco Vitali & C, based in Via Gaetano Crespi, 9 in Milan, CF and PI 09386630967, hereinafter referred to as "MountainGear360", deals with the offer and sale through e-commerce of the products on the website www.mountaingear360.com. MountainGear360, is an authorized reseller, by their respective manufacturers or distributors, of the products listed in its catalog.

Conclusion of sales contracts

The confirmation and dispatch of the order by the Customer ("Customer" means the user of the website www.MountainGear360.com who accesses the e-commerce checkout), according to the instructions that from time to time will appear on the web pages implies having read and fully accepted these general conditions of sale by the Customer. The sales contract between MountainGear360 and the Customer is concluded with the acceptance of the order, even partial, by MountainGear360.

If the Customer is a consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form) once the online purchase procedure has been completed, will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of article 3 and 4 of Legislative Decree 185/99 on distance selling. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for the non-acceptance, even partial, of an order.

Methods of Purchase

The Customer can only purchase the products present in the online catalog at the time of placing the order and viewable online on the website www.mountaingear360.com, as described in the relevant information sheets. The order will be validly processed upon receipt of the confirmation of payment by the bank responsible for managing the collections.

The image accompanying the description of a product may not be perfectly representative of its characteristics but differ in color, size, accessory products shown in the figure. All purchase support information (technical information, buying guide, etc ...) are intended as simple generic information material, not referable to the real characteristics of a single product.

Correct receipt of the order is confirmed by MountainGear360 by means of an email response sent to the email address supplied by the Customer. This confirmation message will contain the date and time of receipt of the order and a Customer order number to be used in any further communication with MountainGear360. The message re-proposes all the data entered by the Customer, any information relating to the essential characteristics of the asset, the indication of the price, payment methods, delivery methods and costs and applicable taxes. The Customer must verify its correctness and promptly communicate any corrections, according to the methods described in this document.

In case of non-acceptance of the order, MountainGear360 guarantees timely communication to the Customer. In exceptional cases we reserve the right (eg unavailability of the goods) to terminate the contract. In this case the customer will be contacted immediately also to propose possible alternatives and MountainGear360 will refund the amount collected within 2 working days.

Prices Local taxes and customs duties

The products will be sold at the prices indicated in the online product sheet upon confirmation of the order by the Customer. Delivery costs are charged to the customer and detailed in the order confirmation form. All prices shown on the website www.mountaingear360.com are inclusive of VAT in accordance with the tax regulations in force and valid for all countries belonging to the EEA area (Economico European area). For all non-EEA countries, the prices are without VAT and taxes and do not take into account customs duties and local taxes that may be applied to clear the goods once they arrive in the country of destination and which are not covered by us.

Accounting Documentation and Delivery Methods

For each order accepted and placed, MountainGear360 issues a tax receipt (or invoice if the Customer is not a Consumer and has indicated his VAT number in the order) of the material shipped, sending it by e-mail to the holder of the order, pursuant to 'art 14 DPR 445/2000. For the issuance of the tax receipt (and / or invoice) the information provided by the Customer at the time of the order is valid. No variation of the fiscal document will be possible after the issuance of the same.

Terms of payment

The Customer can pay by credit card, Paypal, bank transfer and cash on delivery, as better described in the Secure Payment section.

Right of Withdrawal - Return

Pursuant to art. of the legislative decree 6 September 2005, n. 206, as amended by Legislative Decree 21.02.14 n ° 21 (the "Consumer Code"), if the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the form order to MountainGear360 a reference to VAT number), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty within 60 days of receipt of the purchased Product.

To exercise this right, the Customer must send MountainGear360 an explicit written communication to that effect, within 60 working days from the date of receipt of the goods. This communication must be sent:

Once the communication has been received, the MountainGear360 Customer Service will quickly communicate to the Customer the instructions on how to return the goods. The Customer must return the Product (s) by sending it to the address specified by the Customer Service, without undue delay and in any case within fourteen days from the date on which MountainGear360 communicated its intention to withdraw from the contract.

The direct shipping costs relating to the return of the product are charged to the customer. The purchased product must be returned in its entirety and intact, with all accessories and any spare parts, in the original packaging, complete in all its parts (including packaging and any documentation, etc ...). The Customer can manipulate the product in order to establish its nature, characteristics and functioning but is responsible for the decrease in the value of the Product resulting from handling other than that necessary for this purpose.

Upon receipt of the product and after its verification, MountainGear360 Customer Service will issue the full refund, including any shipping costs paid by the Customer for the purchase of the product within and no later than 14 calendar days.

The right of withdrawal is in any case subject to the exceptions referred to in art. 59 of the Consumer Code: in case of damage to the goods during transport, MountainGear360 will notify the Customer of the incident (within the 5th working day from receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier. chosen by him and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the Customer for its return, at the same time canceling the request for withdrawal; MountainGear360 is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; upon its arrival (in the warehouse), the product will be examined to assess any damage or tampering not caused by transport.

Legal Guarantee and Complaints

Despite the most careful checks on our part, it may happen that you receive a poor quality or defective item. In this case, please contact our Customer Service who will be able to follow you in the best possible way in the return procedure by providing for the supply of a new item or possibly issuing a purchase voucher. All products sold by MountainGear360 are covered by the manufacturer's standard warranty and by the 24-month warranty for lack of conformity, pursuant to Legislative Decree 206/05. To use the warranty, the customer must keep the receipt or invoice that he will receive via e-mail in electronic format. The manufacturer's conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, should the defect not be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs, if incurred by MountainGear360. The 24-month warranty pursuant to Legislative Decree 206 / 05 applies to products that present a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the private consumer (a natural person who purchases the goods for purposes not related to his professional activity, or makes the purchase without indicating a VAT number in the order form). The timing of repair or replacement of the product depends exclusively on the policies of the manufacturer and no damage can be requested from MountainGear360 for any delays in carrying out repairs or replacements.
